Patent Registration

The Patents Act 1983 and the Patents Regulations 1986 govern patent protection in Malaysia. An applicant may file a patent application directly if he is domicile or resident in Malaysia. A foreign application can only be filed through a registered patent agent in Malaysia acting on behalf of the applicant.

A patent is an exclusive right granted for an invention, which is a product or a process that provides a new way of doing something, or offers a new technical solution to a problem. That exclusive right granted by a country to the inventor, allowing the inventor to exclude others from making, using or selling his or her invention in that country during the life of the patent registration.

For a patent registration to be granted an invention must be :

  • new/ novel which mean that the invention has not been publicly disclosed in any form, anywhere in the world;
  • involve an inventive step, that is to say the invention must not be obvious to someone with knowledge and experience in the technological field of the invention; and
  • industrially applicable, meaning it can be mass produced.
